Terms and Conditions

At Dive Pursuits we aim to do everything we can to ensure every single transaction is handled with the utmost care and attention. We aim for 100% satisfaction, however for the benefit of both our customers and ourselves we have clearly noted the following Terms and Conditions. 1. All equipment sold is intended for use only by competent individuals or individuals under the supervision of a competent person. Any misuse of this equipment may result in serious injury or death. If you are unsure how to properly use this equipment, you must consult a competent person or obtain appropriate training from a qualified instructor
2. Any returns under warranty must be sent carriage paid at the customers expense, to the contact address noted below.
3. Warranty returns must be accompanied by a copy of their original receipt, without this no returns will be considered
4. The return of saleable goods outside of our return policy, in perfect condition, will be subject to a 20% restocking charge
5. It is recommended that all returns, for whatever reason, are made via registered mail or courier as no responsibility will be accepted for items not received
6. Delivery charges will be applied to all orders, unless otherwise stated
7. Any payments by cheque that are not honoured will be subject to an administration charge of £10.00
8. It should be noted that Dive Pursuits is a trading name of Cannock Scuba Centre Ltd, and that all transactions are undertaken between the buyer and Cannock Scuba Centre Ltd
9. The content of the Dive Pursuits website is open to be amended or changed in any way, at any time without prior notification
10. All customer details held by Dive Pursuits will be managed by Cannock Scuba Centre Ltd in such a way to comply with relevant data protection legislation
11. Customers may be contacted via mail; telephone or e-mail from time to time, by Dive Pursuits about goods or services which may be of interest
12. Any errors in delivery that result from incorrect information being entered by the customer may result in excess costs for re-delivery being applied
13. All goods once released for delivery are the responsibility of the customer, and inspection on delivery is recommended, prior to signing for satisfactory receipt

15. The images contained within this site are representational of the products described only, they may not exactly match the goods being described or those supplied
16. Any goods purchased for fitting are fitted entirely at customers risk. No responsibility will be taken for damage occurred during fitting. Full instructions will always be provided. Fitting should always be carried out by a qualified or competent person
17. Any free carriage offers, when in place, are subject to a fair use policy. This policy may exclude free shipment of trade and / or multiple (2+) heavy items (e.g. cylinders). Free delivery is via 48hr service, upgrade to 24hr service is available.
18. For inclusion in Price Beater, customer must supply evidence of cheaper price from a established UK Scuba retailer with product available for immediate delivery. Dive Pursuits will then attempt to match price provided. This offer may be withdrawn or refused at any time
19. Occasional delays in order processing may occur due to fraud prevention checks. These checks are random, and where ever possible will be kept to a minimum. We reserve the right to reject your ordered at any point if we feel it may be fraudulant
20. For international orders, you will be notified by email for any additional postage costs if not agreed prior to sale. Proof of identify, such as passport or international driving license will be required before order is despatched
21. All currency conversions are approximate and do not include VAT. All transactions are processed in pounds sterling so the rate used will be that of your issuing bank, not our rate listed. Check with your bank for details
22. Collect In Store Services are offered as a delivery service only. All stock is issued from our Warehouse to the requested store, and the sale is processed via our online trading division. Returns can be packages and left at a Store for Return, but any refund will be processed via our online trading division and not issued in store.
23. Our Delivery and Returns policy are as outlined in the appropriate sections on the website. Please read these prior to placing an order
24. Any purchase of these products will be governed by these terms and conditions.
25. All orders are subject to availability and acceptance by us. An order will be considered accepted by us when its order status is Accepted or higher (Packing, Shipped, Completed) AND you payment has been collected. You can check the status of your order by visiting your account
26. Any advice or recommendation you may receive, either by a member of our staff or via the website, is followed or acted on entirely at your own risk.
27. Due to the limited availability of our products, occasionally an item may go out of stock. If this is the case, we will notify you immediately, including an expected delivery date or alternative products / options.
28. Each product carries an estimated delivery period, but please allow up to 30 days for delivery unless otherwise stated
29. You are not entitled to assign or transfer any of your rights or obligations under this contract. This contract shall be governed by the laws of England and you agree to submit to the non-exclusive jurisdiction of the English courts.
30. Free Dive Club Kit offer – All persons signing up to our email newsletter before the end of August 2008 will be entered into a draw to win one aqualung wave bcd, Calypso reg and octo and a single gauge. Only one entry per person. Equipment will be given to winners dive club, not to winner. Proof of membership of dive club will be required. No cash alternative. Dive Pursuits reserve the rights to remove or alter this promotion in any way at any time. Winners dive club will be required to participate in publicity regarding the event.
31. Any orders for products specified or identified as Instructor are for qualified diving instructors only. You must supply a copy of your qualification after placing your order. We are unable to accept your order without this information. Limited to 2 per instructor. These offers may be suject to a closing date or other restrictions (check details for information) and may be removed without warning at any time
32. Choice of Free Gauge applies to certain packages only, check product details for inclusion
33. Any special offers, when in place, can not be combined and / or used in conjunction with any other special offer.
34. Pre Orders. Pre Orders are offered at an estimated price. We will confirm receipt of your order, but will not confirm and accept it until we have confirmed delivery and price information from the manufacturer.
35. Comment Policy – While we value your contribution to our news topics, we reserve the right to enforce the following policy on comments. Keep on topic All comments should be relevant to the artical posted. No Keywords in Names Please use your own name or derivative off when leaving a comment. Language Please keep all comments in English and suitable for all the family. Attacks and / or complaints If you have a complaint against either ourselves, a member of the Pursuits Group or against a manufacturer or supplier please get in touch with us directly. Editors rights We reserve the right to alter, amend, remove or delete any comments for any reason, regardless of whether they meed the above criteria or not
36. Generic Competition Terms – Unless explicity stated, all competition offered by ourselves or any member of the Pursuits Group will be subject to the following terms. Management Descision is final and no correspondence will be entered into. No cash alternative (or other alternative) will be offered. Winner(s) may be used in promotional material and / or advertising purposes. Winner(s) will be notified via provided contact details. Prize(s) must be claimed within 20 calendar days of notification or will be lost.
37. We reserve the right to withdraw any special offers at any time without notice

Price Watch

Our Price Watch system is active across all products on our site, providing comparision pricing from the UK’s other major dive stores, and is subject to the following Terms and Conditions

1. Price Watch (or Price £ Watch) is our service which checks prices of other UK dive centres using Google™ Product Search
2. We attempt to match the product being displayed by us with similar products available in Google™ Product Search.  However, we do not gaurentee the accuracy of the results in any way.
3. We monitor approximately 20 of the other major UK only Dive Shops who publish there price in Google™ Product Search
4. All data show in collected real time from Google™ Product Search
5. We filter the data shown provide better results.  This includes removing items that fall outside a given price range for each item, second hand items, items not from the UK and items not listed by the Dive Shops we have included in our list.  We then display the 4 lowest prices.
6. The list of Dive Stores we monitor consists of approximately 20 of the UK’s other major Dive Centres, which we monitor and update accordingly.
7. We are not responsible for any of the data or results presented on our Price Watch panel.  While we endevour to match like for like products, due to the nature of Google™ Product Search this is not always possible.  Please always ensure you are comparing like for like products.
8. A link to the Google™ Product Search shopping results is provided on each tab.  Also at the bottom of each tab is a link to the XML feed that we are using.  You are therefore free to check the validity of our results at any time.
9. The results presented within Price Watch are for information only, and are not an offer to sell on behalf of any other supplier, or at the price of any other supplier.  Our price will always be advertised next to the product.
